These Terms are a contract between You and Ferguson Enterprises, LLC ("Ferguson," “Company,” “We,” “Us,” or “Our”) with regard to the access and use of Our website - www.ferguson.com - and its component pages, the Ferguson Mobile App, and any other website, application, product or service made available by Ferguson (collectively, “Website”). If You do not agree with the Terms set forth below and Our Privacy Policy (including any modifications thereto), You should exit the Website. However, these Terms and Our Privacy Policy will apply to all of Your information and actions prior to exiting the Website.

To the fullest extent permitted by law, You acknowledge and agree that You are waiving the right to a trial by jury and to the litigation of disputes in state or federal courts of general jurisdiction. You further acknowledge and agree that any arbitration shall proceed on an individual basis only and not as a class action or representative action, and You expressly waive the right to file a class action or seek relief on a class basis.

SEVERABILITY.
